Referral Program Terms

1. The program

The PayWelly Referral Program lets eligible account holders earn rewards for referring businesses that go on to use PayWelly. Reward amounts, thresholds and timing are set out in the separately published Reward Criteria at paywelly.com/legal/referral-rewards, which PayWelly may change at any time.

2. Attribution

A business is attributed to the referral link or code used when its account is created: opening a referral link tags that visitor's browser for 90 days, and a code typed at signup is applied immediately. Either way the referral must be applied within 7 days of the referred account being created. PayWelly may, at its discretion, attribute a business within 30 days of signup on request. PayWelly's attribution decision is final, except that PayWelly may correct an attribution made in error or remove one obtained in violation of §6.

3. Nature of the program

Participation is voluntary. Referring is not work performed for PayWelly, is not an assignment, quota or target, and creates no employment, agency or partnership relationship. You may not represent yourself as PayWelly.

4. Disclosure

If you promote PayWelly publicly you must disclose your material connection (FTC 16 CFR 255.5). Suggested text is provided in your referral dashboard.

5. Payment and taxes

Rewards are paid to your PayWelly balance via Stripe after vesting. Cash rewards are taxable income and may be reported to the IRS; a W-9 is required before payment. You are responsible for your own taxes.

6. Prohibited conduct

Self-referral, referring businesses you own or control, spam, misleading claims, paid advertising on PayWelly brand terms, and any attempt to manipulate qualifying engagements are prohibited and void rewards.

If you post a review or testimonial about PayWelly anywhere, you must clearly disclose that you may receive a referral reward (16 CFR Part 465).

7. Changes and termination

PayWelly may modify or end the program at any time. Vested rewards will be paid. PayWelly may withhold or reverse rewards obtained in violation of these terms.

8. Governing terms

These terms supplement the PayWelly Terms of Service, which govern in case of conflict. The program is void where prohibited. Disputes about the program are resolved under the dispute-resolution terms of the PayWelly Terms of Service.
